Terms & Conditions
§1 General provisions
- The Lessor is FHU „Aga", [VAT no. / address / registration details], the owner or manager of the BRDA 144 event space at ul. Krzysztofa Gotowskiego 6 in Bydgoszcz (the „Venue").
- The Lessee is a natural person, legal entity or organisational unit that has made a booking and concluded a rental agreement for the Venue.
- These Terms set out the rules for booking, renting and using the Venue. Making a booking constitutes acceptance of these provisions.
- The Venue is intended for occasional events, birthdays, 18th birthdays, training sessions, corporate events and workshops.
§2 Booking and conclusion of the agreement
- A date can be booked by phone, e-mail, WhatsApp or via the form on the website.
- A booking is considered confirmed once the date and scope of service have been agreed and a deposit of [e.g. 30% of value / amount] has been paid within [e.g. 3 days] of the preliminary booking.
- Failure to pay the deposit within the set deadline results in cancellation of the preliminary booking without further notice.
- The detailed terms of a given rental (date, hours, number of guests, scope of additional services, catering) are agreed individually and confirmed in writing or electronically.
§3 Payments and security deposit
- The rental fee is set individually based on the Lessee's enquiry.
- The deposit paid at booking is credited towards the final rental amount.
- The remaining fee is payable no later than [e.g. on the day of the event / 3 days before].
- The Lessor may collect a refundable security deposit of [amount] to cover any damage. The deposit is returned within [e.g. 3 days] after the rental ends, once the state of the Venue and equipment has been checked.
- If damage or a breach of these Terms is found, the Lessor may deduct the cost of repair, cleaning or replacement from the deposit.
§4 Rules for using the Venue
- The Venue is available during the hours agreed in the booking. The standard rental period covers [e.g. hours plus time for setup/cleanup].
- The maximum number of people present in the Venue at one time is 69 guests and may not be exceeded for safety reasons.
- The Lessee must use the Venue, equipment, terrace and back-of-house facilities as intended and in line with health, safety and fire regulations.
- The Lessee is responsible for the people attending the event, including their behaviour and any damage.
- After the rental, the Lessee must leave the Venue in a condition fit for further use and return the equipment undamaged.
§5 Lessee's obligations and liability
- The Lessee bears full material liability for damage to the Venue, equipment and the Lessor's property caused during the rental by the Lessee or their guests.
- The Lessee undertakes to notify the Lessor immediately of any damage or faults.
- The Lessor is not liable for valuables or property of the Lessee and their guests left on the premises.
- The Lessee is responsible for obtaining any permits and paying any fees related to playing music (e.g. royalties), where applicable to the event.
§6 Safety and prohibitions
- The following are prohibited on the premises: open flames and pyrotechnics [unless agreed otherwise], and bringing in or possessing hazardous or illegal substances.
- Smoking tobacco and e-cigarettes is prohibited outside designated areas.
- Vandalism, unauthorised moving of installations and removing equipment from the premises are prohibited.
- The Lessor may stop an event that endangers the safety of people or property, breaches these Terms or disturbs the peace.
- The Lessee must observe night-time quiet hours and the order regulations in force at the location.
§7 Catering and food
- The Lessor offers catering in cooperation with a gastronomy partner. Menu details and cost are agreed individually.
- Bringing your own catering or drinks is [allowed / subject to consent / not permitted] - as agreed at booking.
- Use of the kitchen facilities follows hygiene and safety rules.
§8 Cancellation and changes to a booking
- Cancellation of a booking should be reported to the Lessor promptly, in writing or electronically.
- If the Lessee cancels, the deposit paid [refund rules / forfeiture under art. 394 of the Civil Code].
- Changing the event date is possible subject to the Venue's availability, after agreement with the Lessor.
- If the Lessor cancels the rental for reasons attributable to it, the amounts paid are refunded in full.
§9 Personal data (GDPR)
- The controller of the Lessee's personal data is FHU „Aga", [controller contact details].
- Personal data is processed solely to perform the booking and rental agreement, under art. 6(1)(b) and (f) GDPR.
- The Lessee has the right to access, rectify, erase and restrict the processing of their data.
- Detailed processing rules are described in the Privacy policy.
§10 Final provisions
- Matters not covered by these Terms are governed by the provisions of the Civil Code.
- The Lessor reserves the right to amend these Terms. Bookings already confirmed are subject to the Terms in force at the time of booking.
- The parties will seek to resolve any disputes amicably; failing agreement, they will be settled by the court competent for the Lessor's seat.
